Terms & Conditions

1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Pawfolio Sdn. Bhd. ("Pawfolio", "we", "us", or "our"). By accessing or using the Pawfolio platform — including the mobile app, web portal, and any associated services — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account and use Pawfolio. By registering, you represent that you meet this requirement and that all information you provide is accurate and complete. Accounts created on behalf of minors must be managed by a parent or legal guardian.

3. Accounts and Security

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account, whether or not authorised by you.
• Notifying us immediately at hello@pawfolio.app if you suspect unauthorised access.
• Ensuring your account information (name, email, phone) remains accurate and up to date.

We reserve the right to suspend or terminate accounts that show signs of unauthorised use or security compromise.

4. Pet Profiles and Health Records

You may create profiles for your pets and log health records including vaccinations, deworming schedules, weight history, allergies, and vet visits. You are solely responsible for the accuracy of the health information you enter. Pawfolio does not provide veterinary advice — all health decisions should be made in consultation with a qualified veterinarian.

5. Expense Tracking and Shared Expenses

Pawfolio allows you to log pet-related expenses and share costs with co-owners of the same pet. By using the expense sharing feature, you acknowledge:

• Expense amounts are split equally among all active co-owners of a selected pet at the time of recording.
• The split calculation is performed automatically and rounded to 2 decimal places; any rounding remainder is absorbed by the first co-owner (ordered by user ID).
• Expense records are visible to all active co-owners of the associated pet.
• Only the user who created an expense may delete it; co-owners who did not create the expense cannot delete it.
• Pawfolio is a tracking tool only — we are not responsible for any financial disputes between co-owners arising from shared expense records.

6. Co-Ownership (Pet Parents)

You may invite other registered Pawfolio users to become co-owners (pet parents) of your pets. By adding a co-owner:

• They gain access to the pet's profile, health records, and shared expense data.
• They will receive expense share records for expenses logged against that pet.
• You can manage and revoke co-owner access at any time from your pet's settings.
• You are responsible for only adding co-owners who have consented to share their data in this way.

7. Lost & Found Network

The Lost & Found feature allows users to post and browse listings for lost and found pets. By submitting a listing:

• You confirm that the information you provide is accurate to the best of your knowledge.
• You consent to your listing (including pet description and contact details) being visible to other Pawfolio users.
• You must not post false, misleading, or fraudulent listings.
• Pawfolio does not guarantee the reunification of lost pets and is not liable for outcomes arising from use of this feature.

8. Reviews and Community Content

You may submit reviews of pet service businesses and participate in community features. You agree that your content:

• Is honest, accurate, and based on genuine experience.
• Does not contain defamatory, offensive, or illegal material.
• Does not infringe the intellectual property rights of any third party.
• May be moderated or removed by Pawfolio if it violates these Terms.

You retain ownership of content you submit but grant Pawfolio a non-exclusive, royalty-free licence to display, reproduce, and distribute it within the platform.

9. Loyalty Stamps and Rewards

Pawfolio operates a loyalty programme in partnership with pet service businesses. Stamps and points are issued at the discretion of partner businesses and Pawfolio. We reserve the right to modify, suspend, or terminate the loyalty programme at any time. Stamps and points have no cash value and cannot be transferred or redeemed for cash.

10. Subscriptions and Billing

Certain premium features of Pawfolio may require a paid subscription. Where applicable:

• Subscription prices, billing cycles, and included features are displayed at the point of purchase.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are handled in accordance with our refund policy and applicable consumer protection laws.
• We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers.

11. Prohibited Conduct

You must not use Pawfolio to:

• Post false, misleading, or fraudulent pet listings, reviews, or expense records.
• Attempt to access another user's account or data without authorisation.
• Scrape, harvest, or systematically collect data from the platform.
• Interfere with or disrupt the platform's infrastructure or security.
• Use the platform for any unlawful purpose or in violation of applicable laws.
• Impersonate another person or entity.
• Submit spam, unsolicited messages, or malicious content.

Violations may result in immediate account suspension or termination without notice.

12. Intellectual Property

All content, design, code, trademarks, and branding on the Pawfolio platform are owned by or licensed to Pawfolio Sdn. Bhd. and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the platform without our express written permission.

13. Disclaimers

The Pawfolio platform is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. We do not warrant that:

• The platform will be uninterrupted, error-free, or free of viruses.
• Health reminders will be delivered on time in all circumstances.
• Expense calculations will be used as the basis for any financial or legal obligation between co-owners.
• Lost & Found listings will result in the recovery of a pet.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Pawfolio and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the platform, including but not limited to loss of data, financial loss between co-owners, or failure to reunite lost pets.

15. Indemnification

You agree to indemnify, defend, and hold harmless Pawfolio and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

16. Termination

You may stop using Pawfolio and delete your account at any time from your account settings. We may suspend or terminate your access without notice if you violate these Terms, engage in fraudulent activity, or for other legitimate operational reasons. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your use of Pawfolio shall be subject to the exclusive jurisdiction of the courts of Malaysia, without regard to conflict of law principles.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before the changes take effect. Your continued use of Pawfolio after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the platform and delete your account.
